Refund and Cancellation Policy

Effective date:
1 September 2026

This Refund and Cancellation Policy applies to fishing charters booked directly with NeuroWave Fishing Charters through our website, telephone, WhatsApp or another direct communication channel.

Bookings made through FishingBooker or another third-party platform remain subject to that platform’s payment, cancellation and refund terms.

​

1. Booking confirmation

​

Submitting an enquiry does not confirm a booking. A charter is only confirmed once NeuroWave Fishing Charters has:

  • Confirmed the date, departure time, charter type and price;

  • Provided any applicable deposit or payment instructions; and

  • Confirmed receipt of the required payment.

Any outstanding balance must be paid according to the arrangements communicated at the time of booking.

2. Cancellations by guests

​

Guests should notify NeuroWave Fishing Charters of a cancellation or requested change as soon as possible.

​

Cancellations at least 72 hours before departure

Where a direct booking is cancelled at least 72 hours before the confirmed departure time, payments received may be refunded or transferred to another available date, less any reasonable, disclosed and non-recoverable transaction or administrative costs.

Cancellations less than 72 hours before departure

Where a booking is cancelled less than 72 hours before departure, NeuroWave Fishing Charters may retain the deposit or apply a reasonable cancellation charge. The amount will be determined with regard to:

  • The notice provided;

  • The nature and duration of the charter;

  • Costs already incurred;

  • Services or supplies arranged for the trip; and

  • Whether the booking can reasonably be filled by another guest or group.

Any cancellation charge will be applied in accordance with applicable South African consumer law.

3. Late arrival and failure to arrive

Guests are responsible for arriving at the confirmed meeting point by the communicated reporting time.

​

A failure to arrive, or arriving too late for the charter to depart safely or as scheduled, may be treated as a cancellation. Payments may be retained to the extent reasonably permitted by law.

​

The skipper cannot extend a charter where a late departure would interfere with safety, marine conditions, other bookings or operational requirements.

​

4. Weather and marine conditions

All charters are subject to suitable marine weather and safe sea conditions.

The skipper has final authority to change the departure time, route, fishing area, duration or planned activity where conditions require it. A decision made for safety reasons will not be treated as a failure to provide the originally planned route or target species.

If NeuroWave Fishing Charters cancels a trip before departure because conditions are unsuitable, guests may choose between:

  • Moving the booking to another mutually available date;

  • Receiving a credit for a future charter; or

  • Receiving a refund of the charter amount paid directly to NeuroWave Fishing Charters.

NeuroWave Fishing Charters is not responsible for unrelated travel, accommodation, food, transport or other costs incurred by guests.

5. Changes requested by guests

Requests to change a confirmed date, charter type or number of guests remain subject to availability.

​

A change may affect the price, departure time, duration or other booking conditions. The revised booking is only confirmed once NeuroWave Fishing Charters accepts the change in writing.

​

6. Trips shortened after departure

A charter may be shortened or altered after departure if marine weather changes, a safety concern develops, a guest becomes unwell or another circumstance makes continuation unsafe or impractical.

​

Where a trip is shortened for reasons within NeuroWave Fishing Charters’ control, a reasonable partial refund or credit may be considered based on the services already provided.

​

No refund will ordinarily be due where a trip is shortened because of:

  • A guest’s illness or seasickness;

  • A guest’s request to return early;

  • Unsafe, disruptive or unlawful behaviour;

  • Failure to follow the skipper’s instructions; or

  • Circumstances outside the reasonable control of NeuroWave Fishing Charters.

This does not limit any right that cannot lawfully be excluded.

7. Fishing results

Fishing opportunities depend on season, location, marine conditions and fish activity. No species, quantity, size or catch can be guaranteed.

​

A lack of catch does not entitle a guest to a refund where the booked charter and related services were provided.

​

8. Third-party bookings

Bookings made through FishingBooker or another booking platform must be cancelled or changed through that platform. Any refund will be handled according to the platform’s applicable policy and payment process.

​

9. Requesting a cancellation or refund

Please contact NeuroWave Fishing Charters and provide:

  • The booking name;

  • Charter date;

  • Booking reference, if applicable;

  • Reason for the cancellation or refund request; and

  • Relevant payment information.

Approved direct-booking refunds will ordinarily be processed within 10 business days. Bank and payment-provider processing times may vary.

10. Consumer rights

Nothing in this policy is intended to remove or restrict any right available under the Consumer Protection Act 68 of 2008 or other applicable South African law.
