These Terms and Conditions apply to the use of the NeuroWave Fishing Charters website and to charter services booked directly with NeuroWave Fishing Charters.

By using this website, submitting an enquiry or confirming a direct booking, you agree to these terms.

1. About NeuroWave Fishing Charters

NeuroWave Fishing Charters provides guided bay, backline, mid-deep and offshore fishing experiences from Durban, KwaZulu-Natal.

​

Charters are operated subject to availability, marine weather, safe sea conditions and the skipper’s operational assessment.

​

2. Website information

We aim to keep website information accurate and current. However, charter prices, durations, start times, routes, inclusions, target species and availability may change.

Website content is general information and does not constitute a confirmed offer or booking. The details communicated in the final booking confirmation will apply to the selected charter.

3. Booking enquiries and confirmation

Submitting a website form, WhatsApp message or other enquiry does not reserve a charter.

​

A direct booking is confirmed only once NeuroWave Fishing Charters has confirmed the details and acknowledged receipt of any required deposit or payment.

​

Guests must provide accurate contact information, passenger numbers and other information reasonably required to plan the trip.

​

4. Pricing and payment

Prices may be stated per person, per group or per charter. The applicable basis will be confirmed before payment.

Any deposit, balance date and accepted payment method will be communicated during booking. Guests are responsible for checking the confirmed charter, date, passenger count and amount before making payment.

​

Third-party platforms may apply their own deposit, service fee, balance and payment terms.

​

5. Cancellations and refunds

Cancellations, requested changes and refunds are governed by our Refund and Cancellation Policy, which forms part of these Terms and Conditions.

Bookings made through FishingBooker or another platform remain subject to that platform’s policies.

​

6. Weather and operational decisions

Fishing charters are weather-dependent activities.

The skipper has final authority to:

• Delay or cancel departure;

• Change the route or fishing area;

• Change the fishing method or target species;

• Shorten or return from a trip;

• Refuse departure where conditions are unsafe; and

• Take any other reasonable action required for safety or lawful operation.

Guests must follow all instructions given by the skipper and crew.

7. Guest responsibilities

Guests must:

• Arrive at the confirmed meeting point on time;

• Follow safety briefings and crew instructions;

• Behave responsibly and respectfully;

• Use equipment with reasonable care;

• Wear appropriate non-slip footwear and suitable clothing;

• Bring recommended sun protection, water and personal items;

• Disclose relevant mobility or health concerns that may affect safe participation;

• Supervise children in their care; and

• Comply with applicable fishing, environmental and maritime rules.

Alcohol is not permitted aboard unless NeuroWave Fishing Charters expressly confirms otherwise in writing.

Illegal substances, weapons, dangerous behaviour, harassment and deliberate damage are prohibited.

​

8. Children

Children may join selected charters when accompanied by a responsible adult and when the trip is considered appropriate.

​

The parent or guardian remains responsible for supervision and must ensure that NeuroWave Fishing Charters is informed of children joining the trip. Correctly sized life jackets and any additional arrangements should be confirmed before departure.

​

9. Health and fitness

Marine activities involve movement, changing conditions, sun exposure and the possibility of seasickness.

​

Guests are responsible for deciding whether they are medically and physically able to participate. Guests should seek appropriate medical advice regarding seasickness medication or any health concern before departure.

​

NeuroWave Fishing Charters must be informed in advance of a condition or assistance requirement that could reasonably affect safe participation.

​

10. Fishing equipment and catch

Published inclusions may include rods, reels, tackle, lures, licence coverage and live bait when requested. Exact bait and equipment arrangements must be confirmed for the selected departure.

​

Fishing locations, techniques and target species depend on season, conditions and the skipper’s plan. No catch is guaranteed.

​

Catch may be kept or released only in accordance with applicable species rules, size limits, bag limits, closed seasons and the skipper’s instructions.

​

11. Personal belongings

Guests remain responsible for their phones, cameras, fishing equipment, clothing and other personal belongings.

​

To the extent permitted by law, NeuroWave Fishing Charters is not responsible for loss or damage caused by water exposure, ordinary marine conditions or a guest’s failure to secure personal property.

​

12. Photography

Photographs or video may occasionally be taken during a charter. We will seek permission before using an identifiable guest’s image for advertising or promotional purposes.

​

Guests may withdraw permission for future use by contacting us. Withdrawal will not necessarily affect material that was lawfully published before the request was received.

​

13. Conduct and refusal of service

The skipper may refuse boarding or end a guest’s participation where conduct is unsafe, unlawful, abusive, intoxicated or disruptive.

​

A refund will not ordinarily be due where participation is refused or ended because the guest breached these terms or ignored reasonable safety instructions.

​

14. Third-party links and services

Our website may contain links to FishingBooker, social-media platforms, maps, payment providers or other third-party services.

​

Those services operate under their own terms and privacy policies. NeuroWave Fishing Charters does not control and is not responsible for independent third-party content or systems.

​

15. Intellectual property

Website text, branding, photographs, graphics, video and other original material belong to NeuroWave Fishing Charters or are used with permission.

​

Content may not be copied, republished, sold, altered or used commercially without prior written permission.

​

16. Liability

Fishing and marine recreation involve risks that cannot be completely removed, including changing weather, vessel movement, fishing equipment and exposure to the marine environment.

​

NeuroWave Fishing Charters will take reasonable steps to operate safely and provide the agreed service. To the fullest extent permitted by law, we will not be liable for indirect or consequential loss or for loss caused by circumstances beyond our reasonable control.

​

Nothing in these terms excludes liability or consumer rights that cannot lawfully be excluded, including rights under the Consumer Protection Act 68 of 2008.

17. Governing law

These terms are governed by the laws of the Republic of South Africa.

Any dispute will be addressed through the appropriate South African process or court with jurisdiction, subject to any consumer right to approach the National Consumer Commission, a consumer tribunal or another competent body.

18. Changes and severability

We may update these terms when our services, website or legal obligations change.

If one provision is found to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
